LISTA DELLE PERSONE LIBERE’S APPLICATION FORWARDED TO OSCE’S ELECTIONS WATCHDOG

SAN MARINO, October 25th 2016 / Lista delle Persone Libere’s appeal has been forwarded today to OSCE’s Office for Democratic Institutions and Human Rights (ODIHR), a permanent watchdog for elections in its member states.
We believe that the international body should gain knowledge of this highly important application, which represents a venue for clarity and assessment over what level should be reached – while we deemed it obvious – as to compliance to the law in San Marino during elections.
The appeal, filed yesterday and already received by the governmental counterparty, raises several issues of the utter importance, among which a doubt over San Marino legislation’s – not including a special law on this matter – effectiveness regarding remedies against decisions by the Electoral Commission where issued in breach of the law.
Unfortunately Judge Isabella Pasini could not set any hearing for debate concerning the suspension of the rulings, because delivery receipts of certified mails for service are not yet available, thus several days may be passing before this occurs.
Defence requested that the hearing be immediately set, given the extreme urgency of the matter.
